Important Information

CHANGE OF DATE OR VENUE

The photographer must be notified immediately of any changes in schedule or location, at least one week prior to the scheduled date of the event. Notification of any changes can be made by phone along with written notice sent via email for documentation. If an email is sent, a confirmation of receipt must be in writing. It is the client’s responsibility to confirm all arrangements at least 7-10 days prior to the event. In the event of the change of address or contact information (time, etc.) as listed, you must notify Photographer.

 

 

RETAINER

A non-refundable retainer fee of 50% of the total balance is required to hold the date of your event. No date is reserved until a retainer is received. The balance of the complete package price must be paid at the date specified herein. If final payment is not received as set forth herein, Photographer reserves the right to withhold delivery of the images and or not attend the wedding until payment is received. Upon clients signature and payment of retainer fee, Photographer agrees to reserve the date and time specified. The retainer fee is applied toward the final contracted wedding package.

 

CANCELLATION (on client's behalf)

There shall be NO refund of the retainer after 48 hours from the signing of the agreement due to the reservation of the photography date. If the event is cancelled within four months of the date, the client shall pay the balance of the contract due to the high probability that the Photographer will not be able to further book that date. 

Once a balance is paid, it is NON-REFUNDABLE. Any other arrangements shall be discussed between the client and the Photographer. All arrangements will be put in writing. Cancellation must be in writing even if a phone call was made to inform Photographer of the cancellation. The retainer fee will be transferable up to 365 after cancellation. The client agrees to not expect a new date to automatically be available. The client will be given the chance to reschedule but cannot be pushed ahead of other reserved clients.

 

SICKNESS/CANCELLATION (on behalf of The Day I Say)

- In the unlikely event that the Photographer is injured, becomes ill or has an extreme emergency that prevents them from being there on the day of the booking, a trusted + experienced photographer with a similar style will take over for the day - I, The Day I Say, will still be editing + delivering all your gorgeous images to you. 

 

LIMIT OF LIABILITY: I take the utmost care with respect to the exposure, retouching, and transportation of digital captures, proofs and prints. However, in the unlikely event that all the originals are lost, stolen, damaged or destroyed within or beyond Photographer’s control, Photographer’s liability is limited to the refund of all payments received, or a reshoot can be scheduled at no additional cost. The limit of liability for partial loss or damage of originals shall be a prorated amount of the total amount, based on the percentage of originals lost or damaged. This will be discussed, put in writing and a fair agreement between two parties. 

 

a. Client agrees to provide a meal for Photographer if Photographer’s attendance is required for greater than eight (8) hours. 

b. Client agrees to give/have someone give Photographer sufficient warning of key events at the wedding to give the Photographer time to prepare (i.e., bouquet toss, cake cutting, speeches, etc.)

c. Photographer will endeavour to get photographs of as many guests as possible, which may be limited by guests’ cooperation in having their photo taken. 

d. Client agrees that Photographer shall be given precedence in taking photographs over guests with cell phone cameras and other devices. 

e. Client acknowledges Photographer may be limited in scope by rules of the location of the ceremony and/or reception. (i.e., flash photography may not be allowed within a Church)

5. Copyright. Photographer shall maintain the copyright of all photographs. Photographer grants Client permission to make copies of the images for personal use by Client and their family and friends. Sale, publication, or any other commercial use is specifically prohibited without the prior written consent of Photographer.

6. Entire Agreement. The Parties acknowledge and agree that this Agreement represents the entire agreement between the Parties. In the event that the Parties desire to change, add, or otherwise modify any terms, they shall do so in writing to be signed by both parties.
